Do Data Breach Victims Have Standing to Sue?

This is quite interesting. Found this on twitter, and thought the blog would love to see this too. Sounds like there is a split on whether we can sue, but frankly, the companies who have our info should be part of the solution by protecting it the best they can. This includes patching if necessary if the perp gets in via a hole in software installed.

Data breach victims are at risk of identity theft, but the courts are split on whether they have standing to sue the companies that failed to protect their data.

  1. To be honest, we don’t need more suing.
    Yes if bad enough maybe, but even then.
    If you sue, maybe you get something, but not everything.
    Worse, if you sue, maybe you get rid of one or more companies.
    Maybe the bad guys get shafted and you win.
    But because companies and others are worrying about being sued you may have a situation where everything just gets more pricy in case of suing.
    Imagine your insurance extra payments to stop suing and other licences and the like.
    I heard an interesting article out of mexico a few weeks ago.
    There was a train accident where many died.
    Many could have been saved but no one did anything because everyone was concerned about being sued.
    So put it in this context, if every company is scared about being sued, everything will stop.
    Then there will be the free mony trolls.
    We allready have patent trolls can you imagine the data breach trolls?
