This was mentioned as our possible moron of the podcast … a suspect found guilty but attorney will appeal

This was braught up this week and I saw another article on this on Mastodon.

This article we’re taking from is titled Russian cybersecurity expert convicted of charges in $90M hack-to-trade case and comes from Cyberscoop.

Theere may be other articles from other publications but this is the one I spotted first.

Note that Tuesday may not be the same Tuesday as the week it was published.

The first paragraph says:

A Russian national accused of hacking into two U.S. firms that prepare filings for publicly traded companies, and then trading on information before it was public, was found guilty by a federal jury in Boston Tuesday.

We’ve seen an uptick in arrests and possible convictions lately, and this is a good thing.

Vladislav Klyushin is the name of the suspect who is mentioned and linked in the linked article.

His attorney is not pleased with the verdict and looks to appeal the decision. They respect it however, and if this guy truly violated the law and did something wrong, the conviction should stand. Here is that paragraph talking about the disappointment for all to read. It starts out with a quote.

“We are disappointed but respect the jury’s verdict,” Maksim Nemtsev, Klyushin’s attorney, told CyberScoop. “We intend to appeal the various issues including the admissibility of prejudicial statistical evidence, as well as the novel theories of stock fraud and venue that have never before been reviewed or adopted by the First Circuit or the Supreme Court.”

I’m confused on this last statement which makes no sense. What does “prejudicial statistical evidence” mean? And … what does “novel theories of stock fraud and venue that have never before been reviewed or adopted by the First Circuit or the Supreme Court” mean?

Clearly he did something wrong with this 90 million dollars and the jury found him guilty, otherwise if he didn’t or there wasn’t enough evidence, you and your client would have won the case.

It talks about his arrest and there are other linked things which will make quoting and taking this apart further. I suggest you read this further and maybe if someone has any answers on some of this, they can record something for us to air about it if they wish to do so.
